These terms and conditions govern the use of services offered by The Fitness Lab. By using our services, you automatically accept these terms.

1 Acceptance of Terms
By accessing and using The Fitness Lab services, including HYROX training, group classes, nutrition consultations and other fitness services, you agree to comply with these terms and conditions.
If you do not agree with any part of these terms, you should not use our services.
2 Personal and Non-Transferable Account
- The customer account is strictly personal and non-transferable.
- The subscription cannot be shared, assigned or transferred to third parties.
- Access to the facilities is through personal identification (QR code or check-in). It is forbidden to give access to another person.
- Violation of this rule may result in immediate suspension or cancellation of the account, without right to refund.
3 Services
The Fitness Lab offers fitness services including:
- Specialized HYROX training
- High-intensity group classes
- Access to facilities and equipment (Open Lab)
- Personalized training programs (Personal Training)
- Sports nutrition consultations
- Sports coaching and mentoring
We reserve the right to modify, suspend or discontinue any service at any time, with 30 days prior notice.
4 Customer Responsibilities
Health and Safety:
- You must inform about any medical condition or injury before starting training.
- You are responsible for following the trainers' safety instructions.
- You must use appropriate equipment during training.
- You train at your own risk, assuming responsibility for your safety.
Behavior at Facilities:
- Respect other customers and staff.
- Keep the facilities clean and organized.
- Do not use equipment without authorization or incorrectly.
- Follow gym etiquette rules.
- Use of a towel during training and appropriate footwear (clean and indoor) is mandatory.
- Smoking, alcohol consumption or illicit substances are prohibited on the premises.
5 Payments and Subscriptions
- Subscriptions are charged according to the chosen plan.
- Payment is processed automatically through the authorized payment method (MBWay).
- Delays of more than 7 days may result in suspension of services.
- There are no refunds after payment processing.
6 Plan Change (Upgrade/Downgrade)
- Upgrade: The change to a higher plan is immediate. The value corresponding to classes/credits contracted and not used in the current period is deducted from the new plan.
- Downgrade: The change to a lower plan takes effect at the end of the current billing period. There is no refund for the amount already paid.
7 Subscription Cancellation
Cancellation can be requested at any time, being effective at the end of the current billing period. There is no refund for the amount already paid for the current period.
8 Class Bookings and Cancellations
- Class booking and free use (Open Lab) requires a valid and active subscription.
- Bookings are limited to credits available in the contracted period.
Cancellation Policy
- Classes: cancellations must be made at least 15 minutes before the scheduled time.
- Open Lab: cancellations must be made at least 5 minutes before the scheduled time.
- Cancellations made within the specified deadline will result in the session being returned.
- Cancellations outside this deadline result in the loss of the session.
- No-shows (absences without cancellation) are treated the same as late cancellations, resulting in the loss of the session.
9 Use of Facilities and Equipment
- The customer must take care of the conservation and good condition of the facilities and equipment.
- After use, equipment must be put away in the designated place and cleaned if necessary.
- Damage caused by negligence or improper use is the customer's responsibility.
10 Limitation of Liability
The Fitness Lab, its trainers and staff are not responsible for injuries, accidents or health problems that may occur during the use of our services. Customers participate in activities at their own risk, and it is recommended that they have adequate health insurance. In no event will our liability exceed the amount paid for services in the current month.
11 Data Protection
Your personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy.
Data collected:
- Contact information (name, email, phone)
- Health data relevant to training
- Training history and progress
- Payment information
You have the right to access, rectify, delete or limit the processing of your data at any time by contacting us at suporte@thefitnesslab.pt.
12 Complaints
The Fitness Lab provides the Electronic Complaints Book, accessible through the link available in the website footer or directly at www.livroreclamacoes.pt. Complaints can also be sent to suporte@thefitnesslab.pt.
13 Dispute Resolution
Any dispute will preferably be resolved through mediation. As a last resort, Portuguese law and the jurisdiction of the Porto courts will apply.
14 Changes to Terms
We reserve the right to modify these terms and conditions at any time. Changes will take effect 30 days after notification.
You will be notified of important changes via your registered email. Continued use of our services after changes constitutes acceptance of the new terms.
